Terms of service

1. General 

These Terms and Conditions ("T&Cs ") apply to purchases made through the National Museum of Australia's Online Shop ("Museum Online Shop"). 

Additional Conditions of Use also apply to your use of the Museum's website and Online Shop. 

These T&Cs apply to orders accepted by the Museum. From time to time, the Museum may amend these T&Cs. Any amended T&Cs will apply to orders placed after they are published on this website. You should review these T&Cs before placing an order. 

All items are advertised for sale in good faith and the Museum will exercise due care and skill in packaging and dispatching purchases. 

2. Availability of Items 

All items offered for sale through the Museum Online Shop are subject to availability. 

The Museum reserves the right to discontinue products or restrict quantities available for purchase at any time. 

3. Sizes 

Size information is provided as a guide only. Measurements and sizing may vary between products and suppliers. 

4. Orders 

When placing an order, you must follow all instructions and provide all information requested through the online ordering process. 

All prices, taxes, quantities and other details displayed at the time of purchase form part of your order. 

The Museum will send purchases and correspondence to the contact details provided by you and will not be responsible for errors in information supplied during the ordering process. 

The Museum will send an email confirming receipt of your order and payment to the email address provided. 

5. Pricing and Product Descriptions 

All prices are displayed in Australian Dollars (AUD). 

Product descriptions, images and information are provided in good faith and are subject to change without notice. 

Payment of the correct price must accompany all orders. Prices are subject to change without notice; however, you will only be charged the price displayed at the time your order is placed. 

Online prices may differ from prices available at the Museum's physical store in Canberra. 

Items advertised as being on sale are available at the advertised sale price only during the stated sale period. 

6. Taxes 

All prices displayed on the Museum Online Shop include Goods and Services Tax (GST), where applicable. 

GST is not applicable to eligible orders delivered to overseas addresses. Where an international delivery address is entered during checkout, GST will be removed where appropriate. 

Customers purchasing from outside Australia are responsible for any customs duties, import taxes, tariffs or charges imposed by the destination country. 

7. Shipping and Postage 

Shipping charges are calculated based on the delivery location and the shipping method selected. 

The Museum uses Shippit and its delivery partners, including Australia Post and courier services, to fulfil orders. 

Shipping costs are displayed at checkout before payment is completed.

If your order is lost in transit or arrives damaged, please contact the Museum Online Shop as soon as possible at onlineshop@nma.gov.au. The Museum will investigate the matter with the delivery provider and may offer a replacement, exchange or refund where appropriate. 

8. Delivery 

Orders are generally dispatched within five (5) business days of purchase. Processing times may be longer during periods of high demand, stock replenishment or unforeseen operational circumstances. 

Customers will receive a dispatch notification from Shippit once their order has been shipped. Tracking information will be provided where available. 

Delivery timeframes indicated are estimates only and cannot be guaranteed. 

9. International Orders 

International deliveries may be subject to customs inspections and clearance procedures, which can increase delivery times. 

Any customs duties, import taxes, tariffs, fees or charges imposed by the destination country are the responsibility of the customer. 

The Museum does not warrant that products comply with the legal requirements of countries outside Australia and accepts no responsibility for ensuring compliance with local laws in the destination country. Customers should make their own enquiries in relation to customs, quarantine and import requirements.

10. Cancellation 

The Museum reserves the right to cancel an order where: 

  • An item is unavailable; 

  • There is an error in product information; 

  • There is an error in the order; or 

  • The Museum reasonably suspects fraudulent activity. 

Where an order is cancelled, the Museum will notify the customer and promptly refund any payment received. 

 11. Refunds, Returns and Exchanges 

The Museum is committed to meeting its obligations under the Australian Consumer Law. 

If an item is faulty, damaged, incorrectly supplied, or if you are otherwise entitled to a remedy under the Australian Consumer Law, the Museum will provide a refund, replacement, repair or exchange as appropriate. 

The Museum does not generally offer refunds or exchanges for change-of-mind purchases. 

Requests for returns, refunds or exchanges should be submitted to onlineshop@nma.gov.au.

12. Exclusion and Limitation of Liability 

To the maximum extent permitted by law, the Museum excludes all liability to any person for any loss or damage (including indirect or consequential loss) arising from: 

  • Use of this website; 

  • Reliance on information published on this website; or 

  • The supply or failure to supply products purchased through the Museum Online Shop. 

Nothing in these Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded. 

Where liability cannot be excluded, the Museum's liability is limited, at its election, to: 

  • Replacing the goods; 

  • Supplying equivalent goods; 

  • Repairing the goods; or 

  • Paying the cost of replacing or repairing the goods. 

The functions of the Museum Online Shop or delivery services used may occasionally be interrupted by system maintenance, technological issues or events outside the Museum's control. While reasonable efforts will be made to maintain continuity of service, the Museum does not guarantee uninterrupted access. 

13. Governing Law and Enforceability 

These Conditions are governed by the laws of the Australian Capital Territory. 

By purchasing through the Museum Online Shop, you agree to submit to the exclusive jurisdiction of the courts of the Australian Capital Territory. 

14. Security 

The Museum uses a contracted service provider, Shopify Payments, to securely process online credit card payments. 

When you purchase an item through the Museum Online Shop, your credit card details are processed only by Shopify Payments. The Museum does not record or store your credit card information. 

While the Museum uses secure payment systems, it cannot guarantee the security of information transmitted over the internet and accepts no responsibility for information intercepted during transmission. 

15. Personal Information 

The Museum uses a third-party provider, Shopify, to collect personal information when you make a purchase through the Museum Online Shop. 

Your personal information is collected for the purposes of: 

  • Processing and fulfilling your order; 

  • Communicating with you regarding your order; and 

  • Providing information about Museum activities, products and services where you have requested to receive such communications. 

The Museum may disclose your personal information to Shippit, Australia Post, courier providers and other service providers involved in processing and delivering your order. 

The Museum retains order information (excluding payment card details) for customer service purposes, including managing returns, refunds and exchanges. 

The Museum handles personal information in accordance with its Privacy Policy and the Privacy Act 1988 (Cth). 

The Privacy Policy explains how you may access or correct your personal information and how to make a privacy complaint. 

A copy of the Privacy Policy is available on the Museum's website. 

For the purposes of this clause, "personal information" has the meaning given in the Privacy Act 1988 (Cth). 

16. Comments or Concerns 

The Museum welcomes customer feedback and will respond promptly to concerns or complaints.
